All content (including photos and all data contained or appended to the computer file of such photos) that you submit may be used and shared with authorized third-parties at CPC’s sole discretion. CPC reserves the right to change, condense or delete any content on the CPC Sites that CPC deems, in its sole discretion, to violate these Terms. CPC does not guarantee that you will have any recourse through CPC to edit or delete any content you have submitted. You acknowledge that you, not CPC, are responsible for the contents of your submission. Disputes

You hereby consent to the exclusive jurisdiction and venue of the courts, tribunals, agencies and other dispute resolution organizations in CANADA in all disputes (a) arising out of, relating to, or concerning the CPC Site and/or these Terms; (b) in which the CPC Site and/or these Terms present is an issue of a material fact; (c) in which the CPC Site and/or these Terms are referenced in a paper filed in a court, tribunal, agency or other dispute resolution organization; (d) arising out of relating to any products or services sold or distributed by CPC whether over the phone, or online; and (e) related to CPC’s advertising, communication, delivery, or sales practices relating to its products and services. Use of the CPC Site is unauthorized in any jurisdiction that does not give full effect to all provisions of these Terms, including without limitation this paragraph and the warranty disclaimers and liability exclusions.

CPC has endeavored to comply with all legal requirements known to it in creating and maintaining the CPC Site, but makes no representation that materials on the CPC Sites are appropriate or available for use in any particular jurisdiction. Use of the Site is unauthorized in any jurisdiction where all or any portion of the CPC Sites may violate any legal requirements and you agree not to access the CPC Sites in any such jurisdiction. WITH THE PRIOR AGREEMENT OF Canada Pump Center, ANY CLAIM, DISPUTE OR CONTROVERSY ARISING OUT OF, RELATING TO OR CONCERNING THIS SITE AND/OR THIS AGREEMENT SHALL BE DECIDED BY BINDING ARBITRATION IN ACCORDANCE WITH THE RULES OF THE AMERICAN ARBITRATION ASSOCIATION AND ANY SUCH ARBITRATION PROCEEDINGS SHALL BE BROUGHT AND HELD IN CANADA. CLAIMS MAY ONLY BE BROUGHT IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PURPORTED REPRESENTATIVE OF ANY CLASS. THE DECISIONS OF THE ARBITRATORS SHALL BE BINDING AND CONCLUSIVE UPON ALL PARTIES INVOLVED AND JUDGMENT UPON ANY AWARD OF THE ARBITRATORS MAY BE ENTERED BY ANY COURT HAVING COMPETENT JURISDICTION. THIS PROVISION SHALL BE SPECIFICALLY ENFORCEABLE IN ANY COURT OF COMPETENT JURISDICTION.

General

You agree that CPC may at any time and without notice change the terms, conditions and notices under which the CPC Sites are offered; however, any change to the terms after your last usage of the CPC Site will not be applied retroactively.

You agree that no joint venture, partnership, employment or agency relationship exists between you and CPC as a result of this agreement or your use of this CPC Site.

CPC’s performance of these Terms is subject to existing laws and legal process and nothing contained in this agreement is in derogation of CPC’s right to comply with law enforcement requests or requirements relating to your use of the CPC Site or information provided to or gathered by CPC with respect to such use.

These Terms, the Privacy Policy, and terms of sale constitute the entire agreement between you and CPC with respect to the CPC Sites. This agreement supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between you and CPC with respect to this CPC Site. No modification of this agreement shall be effective unless it is authored by CPC or its affiliates. Any alleged waiver of any breach of this agreement shall not be deemed to be a waiver of any future breach. A printed version of this agreement and/or of any notice given by CPC in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to these Terms or your use of this CPC Site to the same extent and subject to the same conditions as other business documents and records originally generated and maintained by CPC in printed form.

Warranty Policy

Products sold in Canada Pump Center website, come with 1 year warranty. All tanks have 5 years warranty starting from purchase date(invoice date). 

Warranty claims will be rejected in the following situations:

1. If the defect in the product arises from:

•  Any drawing, design or specification supplied by the customer/purchaser
• Modifications undertaken by the customer/ purchaser or a third party without the consents of Canada Pump Center

1. If a defect is caused by:

•  Normal wear and tear
•  Inadequate maintenance or faulty repair by others than our service department.
•  Failure to observe the operating instructions
•  Over- loading
• Use of any unsuitable material
• The effects of chemical or electrolytic action
• Building or assembly work not undertaken by Canada Pump Center
• Other reasons beyond Canada Pump Center control.
• You are responsible to send All the information and documents like pictures or videos that our service department require from you.
• If we notice that you do not have a reliable electrical protector for any possible problems, your warranty will not be accepted

As a general rule, Canada Pump Center will not accept to pay transportation/replacement/installation costs for faulty products.

Warranty claims may also be submitted by contacting the local Canada Pump Center office or the point of sale.

[Attention: Please make sure that you complete the warranty form, for your products immediately after your purchase and prior to the installation, or your warranty will not be accepted]

 

Picture ID Required

For our customers’ safety and protection, If the Billing and Shipping addresses are different,  we might call and ask for your picture ID after you place your order, to make sure our customer’s card is not being used by somebody else.

• If you cancel your order right after you place the order, even if we do not ship out, we have the right to charge you the credit card processing fee.

Our Return Policy

You may exchange or return product for a refund (excluding shipping and handling charges) within 30 days of purchase. All items must be in new, unused, untested condition. Items tested in any manner are not returnable. If you are returning an item in which we paid the shipping/handling charge you will be responsible for the outbound shipping charge that we, as the shipper, incurred to have your order delivered. This amount will be deducted from your refund. If you do return an item that has been used and is not in resalable condition, the customer will be charged a cleaning fee of up to 50%, depending on how much labor and time is involved in cleaning the item. If any item is damaged, we will deduct the cost of that item from the refund. Special order items are not returnable. Every return requires a return authorization number (RA) from us.

Return Procedures:

Every return requires a return authorization number (RA) from us. All Returns require this authorization number. Please note that an RA# does not guarantee a refund. All returns are subject to inspection by us. All exchanged/returned merchandise must be in original factory condition, including all packaging materials, manuals, warranty cards (not filled-out) and all accessories. Please do not tape or write anything on the item or the package! We reserve the right to charge you for replacement of damaged, altered, missing, written-on or taped-on contents or cartons. We reserve the right to refuse any such returns. Pack the products into a shipping box with plenty of packing material, and tape securely. Write the RA# issued by Customer Service clearly on the outside of the shipping box. Any merchandise returned to us unauthorized will be refused. We are not responsible for shipping cost(s) incurred on any products(s), no matter the reason for the return.

Please inspect your order immediately and notify us right away if there is any damage to
your merchandise.

• No refunds on custom orders, no refunds on special orders, any item that is not in our stock.
• No refunds on any sewage pump that has been used.
• All returns must be authorized and customer must write the return number on the package or the return will not be accepted.
• No Refunds on any products that has been wired or connected to the pipes
• No Refund on any product that’s been assembled pump with motor

  All regular returns will be charged a 20% restocking fee.

  All cancelled orders and returns will be charged a 6% credit card processing fee on top of the restocking fee.

  All items returned must be in salable condition for a full refund, shipping fee is not refundable.
